Divorces in Brazil reach record with 80,573 acts in 2021

The year 2021, the second of the new coronavirus pandemic, was marked by the completion of 80,573 divorces in Brazil, a record number in the historical series started in 2007. The information is from the Notary College of Brazil – Federal Council (CNB/CF). The entity institutionally represents the Brazilian notary public and brings together the 24 sections of the states and the 8,580 notary offices in the country, where separations, divorces, inventories and divisions can be carried out since 2007.

The number recorded in 2021 means an increase of 4% compared to 2020, when 77,509 divorce deeds were drawn up in notary offices, a previous record of dissolution of marriages by notarial means in Brazil. In total, there were 2,800 more divorces compared to 2020.

The largest increases in divorces made in 2021, compared to the previous year, were recorded in the Federal District (40%), Amapá (33%), Acre (27%), Pernambuco (26%) and Roraima (19%).

In absolute numbers, the Federal District also marked the greatest expansion of acts, with 733 more divorces in 2021 compared to 2020. Then appear Rio Grande do Sul (477), Rio of January (469), Pernambuco (373) and Bahia (343). The data are contained in the Shared Electronic Services Center (Censec), a data platform managed by the Notary College of Brazil (CNB/CF).

As explained by Giselle Oliveira de Barros, president of the CNB/CF, “divorces in notary’s offices, called extrajudicial, were growing year after year as people became aware of their advantages, such as agility, deadline and price. With the migration of notarial services to the electronic medium, the ease of doing the act online, without moving, became an even greater differential, as many were in isolation and managed to solve pending personal life remotely”, said Giselle.

The e-Notarial platform was nationally regulated by Provision nº 100 of the National Council of Justice (CNJ) and allows the practice of almost 100% of notarial acts by electronic means, such as all types of deeds, powers of attorney, wills and notarial minutes.

The process is carried out online, through the platform e-Notarywhere the couple, in possession of a digital certificate issued free of charge by a notary’s office, will be able to declare and express their will in a videoconference conducted by a notary.

According to information from the CNB/CF press office, after contacting the notary of their choice, the couple has scheduled a videoconference with the notary to carry out the deed, which is digitally signed with a notarized digital certificate or by ICP -Brasil, national standard digital signature used, for example, to declare income tax. The services of this platform are also available on mobile devices.

in the state of Rio of JanuaryIn 2021, notaries registered a historic record of divorces (6,039), an increase of 8% compared to 2020, when 5,570 divorce deeds were drawn up in notary offices. In absolute numbers, there were 469 more divorces than in the previous year. In 2018, there was also an increase compared to 2020, when 5,858 divorces were made, 288 more than in the first year of the coronavirus pandemic. Before 2018, the average number of divorces in the state of Rio was 3,217 per year.
