Disproportionate seizures threaten industrial fishing

A total of three industrial fishing companies suffered the seizure of their vessels as part of the process of asset forfeiture due to administrative infractions.leaving its entire crew out of work, damaging the fishery production national, supported the National Fisheries Society (SNP), the Single Union of Fishermen of New Vessels of Peru (SUPNEP) and the National Association of Fishing Shipowners of Law 26920.

In a statement, the unions indicated, first of all, that industrial fishing is a formal, highly regulated activity in our country, and one of the pillars of the national economy due to the generation of jobs and foreign exchange. They specified that this activity contributes to guaranteeing food security in Peru and the world, because it is developed in compliance with high international standards of sustainability and conservation of hydrobiological resources.

For this reason, they regretted that, despite the contribution of this activity, measures such as asset forfeiture have been applied disproportionately, which is mainly used to combat illicit activities carried out by organized crime such as illicit drug trafficking, terrorism. , kidnapping, extortion, money laundering, illegal mining and others with the capacity to generate money, goods or profits of illicit origin.

“Unfortunately, this measure has been applied disproportionately to activities carried out by formal companies (…). Such is the case of the industrial fishing sector, which is at serious risk due to the seizures of recently produced vessels, generating a serious crisis that affects workers, businessmen and suppliers who operate within the legal framework,” they stated.

They maintained that the current interpretation of the domain forfeiture process by the authorities has exceeded its original objective; seriously affecting the sustainability of formal economic activities.

“Equating an administrative infraction to a serious crime and subjecting it to sanctions typical of organized crime distorts the purpose of this process, unfairly affecting honest workers and businessmen,” they stated.

The organizations urged the authorities to urgently review and adapt domain forfeiture rules, ensuring that they are not used in an arbitrary or disproportionate manner against the fishing sector or any other activity, the nature of which does not apply. In addition, they demanded that the authorities focus on effectively combating organized crime, without impacting those who operate legally.
