Dino says that Congress did not send all documents on the amendment to the STF

Federal Supreme Court (STF) minister Flávio Dino said this Thursday (3) that Congress “only partially complied” with one of the decisions made in the process dealing with parliamentary amendments RP8 and RP9 (commission and rapporteur amendments to the budget ), called the “secret budget”.Dino says that Congress did not send all documents on the amendment to the STF

In a decision handed down today, the minister found that Congress did not send all information to the Supreme Court regarding the allocations or changes in the allocation of resources from the RP 8 amendments (commission) in 2024.

Given the lack of information, Flávio Dino determined that the documents must be gathered within 15 days.

“While she [juntada] is not proceeded faithfully, any new judicial deliberation on RP 8 amendments will be impossible, given the constitutional requirements of transparency and traceability”, decided the minister.

On Monday (30), Flávio Dino called a new conciliation hearing between the federal government and Congress to deal with the amendments. The meeting will be on October 10th.

The hearing should include representatives from the Senate, the Chamber of Deputies, the Attorney General’s Office (AGU) and the Attorney General’s Office (PGR). Psol will also participate in the meeting because it filed the petition that questioned the secret budget.

In December 2022, the STF understood that the amendments called RP 8 and RP 9 are unconstitutional. After the decision, the National Congress approved a resolution that changed the rules for distributing resources through rapporteur amendments to comply with the Court’s determination.

However, Psol, the party that filed the lawsuit against the amendments, pointed out that the decision continues to be in non-compliance.

After the retirement of Minister Rosa Weber, the original rapporteur of the case, Flávio Dino took over the management of the case.

In August of this year, Dino determined that amendments must follow traceability criteria. The minister also ordered the Comptroller General of the Union (CGU) to audit the transfers made by parliamentarians through amendments to the secret budget.
