Minister Flávio Dino of the Federal Supreme Court (STF), authorized on Monday (11) the Federal Government to ensure the continuity of payment of assistance for victims of the Zika virus.
Dino complied with the request made by the Attorney General of the Union (AGU) to ensure the legal certainty of payments after legislative changes on the matter.
By the decision of the minister, the assistance is guaranteed to all children who fit the criteria established in the Law 15.156/2025.
According to the norm, the victims are entitled to indemnity in a single installment of R $ 50 thousand, as well as special, monthly and lifetime pension. The benefit applies to people with permanent disability of congenital disease due to the Zika virus.
“This is an unprecedented social vulnerability and public health, resulting from an outbreak that has reached a delimited set of mothers, markedly in certain regions of the country, and to which, until the present time, there is no uncontroversial scientific explanation. At this juncture, the judiciary can and must ensure the realization of these rights,” Dino argued.
Payments were foreseen in a bill that was partially vetoed by the Presidency of the Republic for lack of adequacy to the tax rules. However, a provisional measure kept payments. Then the measure lost its validity. Given the impasse, a new bill came to be valid, but there was no legal certainty to maintain the benefits.
