A new controversy would be added to the extensive history of President Dina Boluarteif it fails to justify the alleged imbalance in assets that the Comptroller General of the Republic has made known, recently confirmed by its head, Nelson Shack.
From the closest sphere of the Government Palace, both her lawyer Juan Carlos Portugal and Prime Minister Gustavo Adrianzén, have communicated to the media that in the next few days they will give a response to the report that said state entity shared regarding the income and expenses of the president.
La República contacted criminal lawyer Benji Espinoza and Joel Córdova, who has been a lawyer for the State Attorney General’s Office, to talk about the consequences that would arise if Dina Boluarte’s alleged imbalance were not justified.

Criminal lawyer Benji Espinoza says that if Dina Boluarte’s response to this Comptroller’s report does not correct what was observed by said entity, it would be appropriate for the Prosecutor’s Office file a constitutional complaint, where the most reliable evidence would be the president’s documentation.
“A key element that appears in the criminal law is the disproportion between income and expenses that produces imbalance, it would be a compelling element. It would prove the most important element of the crime of illicit enrichment. I think it could mark a fateful decision for Boluarte in this investigation and I make this clarification because the Prosecutor’s Office dismantled the files, separated the cases. and the complaint he filed was for bribery over Rolex issuesbut he stuck with the enrichment investigation, which, in my opinion, is more solid,” he said.

Dina Boluarte: alleged financial imbalance would further affect her legal situation
On the other hand, Joel Córdova, regarding the Dina Boluarte’s investigation in the Prosecutor’s Office for illicit enrichmentstates that if this unjustified increase in assets is confirmed, it could be a strong indication of the commission of this type of crime, especially because the period in which this apparent increase occurred is when she already held the position of President of the Republic.
The former attorney for the Attorney General’s Office says that there are two possible scenarios if Dina Boluarte fails to justify this fact. On the one hand, the Public ministry would be closer to proving her investigation for illicit enrichment. On the other hand, new investigations could also be opened if this increase in assets can be linked to other events where irregularities or interferences outside the president’s sphere of competence are identified.
“It is possible that the Public Prosecutor’s Office will request from the Comptroller’s Office all the information that they have been collecting on the case. Although this could be investigated as a false statement in an administrative procedure, it could merit special attention from the Public Prosecutor’s Office to investigate the origin of said funds,” he added.
