Dina Boluartewill continue to face a preliminary investigation in theNational Prosecutor’s Officefor the alleged crimes of illicit enrichment and failure to record statements in a document to the detriment of the Statewithin the framework of Rolex case. This after Supreme Judge Juan Carlos Checkley declared “consented” the resolution in which he declared the request for time control presented by the dignitary’s defense to be unfounded.
This resolution was given last September 24. The next day, the 25th, the decision was notified to both the Prosecutor’s Office and the defense of the head of state, represented by the lawyer Juan Carlos Portugal.
The lawyer could file an appeal within three days, in accordance with article 414 of the Criminal Procedure Code, however, he did not do so. This was interpreted by the judge as agreement with the initial resolution.
“Having said period elapsed without the party having filed any challenging appeal, with the formalities established in the procedural rule, its willingness not to challenge is evidenced. That is, with said procedural conduct it denotes its agreement with what was resolved; therefore , the resolution in question must be declared approved,” the document reads.
“The deadline established by law has expired definitively and irrevocably, without any challenging appeal having been filed, thus consolidating the finality of the resolution,” he adds.

What are the reasons why Dina Boluarte is being investigated?
- Using three Rolex watches: You are accused of using three Rolex watches, which could be related to illegal activities.
- Asset increase: His assets increased by more than S/400,000 soles, which raises suspicions of illicit enrichment.
- “Cartier” brand bracelet: He is credited with wearing a “Cartier” brand bracelet valued at more than US$500,000, which is also part of the accusations.
- Deposits of unknown origin: He would have received cash deposits of S/1.1 million soles and US$2,200 US dollars whose origin has not been clarified.
- Alleged crimes of illicit enrichment and omission of declarations: The specific accusations are limited to these two crimes, as established in articles 401° and 429° of the Penal Code.
Meanwhile, thepresident of the nationduring his last interrogation in theProsecutor’s Officestated that she did not know that the watches were high-end and that for her they were always “nice watches.” He denied having favored Oscorima with emergency decrees in exchange for the watches. In his words, the emergency decrees were not exclusive to Ayacucho, but rather applied to various regions of the country.
He also indicated that he decided to return the Rolex watches to Oscorima because they were not practical. He argued that these automatic watches had problems, as they stopped and showed incorrect times and dates, which was embarrassing during public events.
