The president’s lawyer Dina BoluarteJuan Carlos Portugal, assured this Tuesday that the president has no legal or political obligation to report on the surgical procedures to which she undergoes.
“It has no duty to do so, nor the legal or political obligation to do so,” he said on RPP.
In that sense, the lawyer pointed out that the crime of omission of duties or unjustified abandonment of the position, the reason for which Boluarte is being investigated, does not apply in the case of his client.
“It is a crime of an omissive nature, I do not do something that the law requires me to do. (…) There is no express rule that establishes that the president, regardless of the type of surgery, has to inform the president of Congress “he stated.
Portugal indicated that, in the future, “perhaps that requirement or precision should be made.”
The lawyer assured that the head of state’s alleged respiratory problem “dates back to 2011.” Along these lines, he announced that documents will be delivered to the Public Ministry that confirm the date since his health problem began. In fact, it was said that this would be done yesterday. And it didn’t happen.
When asked why the president did not inform citizens that she would undergo an operation, he reiterated that there were no risks “because they were consulted, prior to the intervention, if there were any complications and it was absolutely neutral.”
“They operated on her for between 40 and 50 minutes, with local anesthesia, she was awake for two and three hours, she was dispatching,” he said.
In that sense, he indicated that according to surgeon Mario Cabani, the anesthesia used “allows the person to be conscious at all times.”
“The intervention is so mild that you immediately stop and in 10 minutes you can develop intellectual activities,” he said.

President Dina Boluarte’s lawyer revealed that surgeon Mario Cabani “did not intervene” but rather “assisted” her, despite the fact that the surgery was performed at the Cabani Clinic.
“Cabani did not intervene, a doctor specialized in her respiratory problem intervened. Mr. Cavani attended. I cannot provide classified information due to the confidentiality of the investigation. He availed himself of his right to professional secrecy,” he highlighted.
