MADRID, Spain.- Cuban Vivian Limonta Reyes, mother of a two-year-old child, has been experiencing a distressing situation since she was deported to Cuba from the United States on August 27 along with 47 other people. Limonta, whose son underwent surgery in her absence in the northern country, faces separation from her family, which makes her feel desperate. Her immigration lawyer, Eduardo Soto, holds the US authorities responsible for what he considers a mishandling of the case and the violation of his client’s rights.
As the lawyer explained to Telemundo 51“U.S. violated its own laws by physically deporting her without having decided on the reopening motion.” Soto claims that his client had the right to remain in the country until the legal proceedings were resolved. The lawyer presented the motion to reopen the case, alleging that the deportation was carried out in absentia and without adequate notification.
The US Department of Immigration and Customs Enforcement (ICE) responded through a statement sent to Telemundo 51, where it noted that the last motion to reopen Limonta’s case was presented in October 2020 and that it was shortly denied. later, which justified his deportation. However, Soto maintains that if the court accepts the lack of notification arguments, Limonta would have the right to return to the United States.
Vivian, who is married to Osmani Pérez, a US citizen, expressed her pain over the separation from her son Celin, a two-year-old boy diagnosed with autism and who recently underwent surgery at Nicklaus Children’s Hospital in Miami. “I am devastated. “I am speechless,” Limonta declared from Havana to Univision after being deported. “I never thought that the United States government would separate me from my son and deport me.”
