Derrite wants changes in the conduct of custody hearings

In the past, the former Secretary of Security has already said that he is in favor of restricting the cases in which the detainee has the right to undergo a custody hearing, but not of terminating it.

“I received a suggestion that will probably become an amendment, to change the issue of the custody hearing.”

The rapporteur participated, on the morning of this Wednesday (12), in a formal session at the National Congress, in Brasília, which paid tribute to the four police officers killed during Operation Containment, which began on the 28th, in the Alemão and Penha complexes, in Rio de Janeiro.

A military police officer since 2003, Derrite has already criticized custody hearings on several occasions, including when he was responsible for the São Paulo Public Security Secretariat – a role he left last week in order to temporarily resume his parliamentary mandate and, thus, take on the rapporteurship of another bill that was already being processed in the Chamber of Deputies and which, among other things, proposed to equate criminal factions with terrorist organizations.

“I had been assigned to return to the Chamber to report on an anti-terrorism project by federal deputy Danilo Forte (União-CE), but after Operation Containment, the federal government hurriedly forwarded another project, and the president of the Chamber, deputy Hugo Motta, appointed me to be the rapporteur and bring together what was good in each of the two projects.”

In just five days, Derrite presented three alternative texts to the project that the federal government sent to the National Congress and which is now being called a “legal framework for combating organized crime”.

The latest change was announced on Tuesday night (10), maintaining the powers and autonomy of the Federal Police (PF) and not equating criminal factions such as Comando Vermelho (CV) and Primeiro Comando da Capital (PCC) with terrorist groups..

“We are also handing out harsher sentences, of at least 20 years, which can reach 40 years, with an increase of 2/3 if the crimes are committed against public security agents. And more than imposing a sentence that can reach 60 years in prison, convicts will have to serve 85% of the sentence in a closed regime. This is the paradigm that changes public security in the country.”
