Sergio Vergaradeputy to the National Assembly 2015 (AN), for the state of Táchira, warned that the proposal to reform the Statute Governing the Transition to Democracy —legal instrument that until now has justified the validity of the interim government led by Juan Guaidó—, presented this Wednesday, December 21 by parliamentarians from Un Nuevo Tiempo (UNT), Primero Justicia (PJ), Acción Democrática (AD) and Movimiento por Venezuela (MPV) “promotes a parliamentary coup.”

This Wednesday morning, members of the four parties -also deputies of the AN 2015-, presented the reform and indicated that it proposes to eliminate the figure of the interim government, but maintain the activity of the AN elected in 2015, which would extend three years more than the five years established by the Constitution, arguing that the AN elected in 2020 that manages Chavismo is unconstitutional.

The Parliament, however, would have more specific functions and would focus mainly on the defense of Venezuelan assets abroad, since countries like the United States, the United Kingdom or Portugal maintain blocked assets of the country that were in the hands of Chavismo.

In Vergara’s opinion, the elimination of the interim government, all its organs and provisions, would mean a “declaration of surrender to the dictatorship.” And he warned that this would cause the collapse of the entire institutional platform that has been built during these years and, for which, it has proven to be effective in guaranteeing international recognition and the protection and administration of State resources.

He described the proposal as “delicate and serious” warning that it “eliminates all reference to usurpation. All mention of the ignorance of (Nicolás) Maduro and the usurped authorities. It eliminates the chapters referring to the reinstitutionalization and the formation of a Provisional Government”, said the coordinator of Popular will in Tachira.

Deputy Vergara stressed that the aforementioned proposal establishes that the AN 2015 and the Delegate Commission (CD) assume executive powers by submitting to their authority the new Board of Administration and Protection of Assets; authorize use of resources and process cooperation; They appoint and remove members of the PDVSA board of directors.

They also designate international representatives in matters of human rights, migration and humanitarian aid and the fight against corruption, denouncing that it is similar to the positions held by commissioners Miguel Pizarro and Carlos Paparoni, simulating the structure designed by the Presidency in Charge.

Questioned Articles

Vergara questioned articles 6, 8 and 18 of the reform of the Transitional Statute, exposed on the morning of this Wednesday, December 21 by the deputy Alfonso Marquina.

“In its article 6, the illegitimacy of the events of May 20, 2018 and December 6, 2020 to declare the nullity of the acts of the usurped authorities without complying with article 233 due to the absolute lack of the Presidency of the Republic , seeking a vacuum that opens the door for the recognition of Nicolás Maduro”, he said.

While article 8, “grants powers to dispose of appeals to the Delegate Commission (CD), which does not even have constitutional powers to legislate in a clear demonstration of the spirit of the constituent to limit its functions.”

In the same way, he indicated that article 18 repeals all the laws enacted in the framework of the transition and all the entities and officials designated by the Presidency in Charge are without effect, creating an institutional chaos regarding recognition that will take months to resolve.

On the other hand, the parliamentarian affirmed that he supports the reform proposal presented by the president of the AN 2015 and the Government in Charge, Juan Guaidó, highlighting that the intention of this project, “is focused on extending the validity as it has been done in years and respect the consensus reached. Which have proven to be efficient to achieve and sustain international recognition, the protection of assets and the dynamics of counterweights of the powers”.
