Deputy Rui Falcão (PT-SP) asked on Monday (8) from Minister Alexandre de Moraes, from the Supreme Federal Court (STF), the opening of an inquiry against the governor of São Paulo, Tarcisio de Freitas, for coercion crimes in the course of the process, incitement to crime and violent abolition of the Democratic Rule of Law.
The representation was filed after the governor’s statements during the acts made on Sunday (7), in an amnesty defense to former President Jair Bolsonaro. In the speech given yesterday, Tarcisio said that “no one can handle the tyranny of Moraes” and that “will not accept that no dictator says what we have to do.”
The request was sent to Moraes, because the minister exercises the rapporteur of the lawsuit about the coup plot. The minister may file the request or send it to the Attorney General’s Office (PGR).
Among the arguments presented, the deputy said that the governor’s statements intend to encourage disobedience to STF decisions and intimidate the ministers in the midst of the trial of the coup plot.
“The speeches occurred during political act in defense of amnesty for Jair Bolsonaro and his allies, accused of attempted coup and other crimes. Thus, Tarcisio’s declaration is not isolated, but part of a strategy of delegitimation of the judiciary and preparation for amnesty impunity, which reinforces the apparent illicit character of the demonstration,” says the deputy.
The parliamentarian also added that the discourse cannot be understood as freedom of expression.
“The use of the word dictator to qualify an STF minister is not a harsh criticism or political rhetoric: it is institutional aggression, that seeks to delegitimize judicial decisions and to instigate the perception that they should be failed. It is very serious that such a statement departs from those who have responsibility to govern the largest state of the federation,” he added.
