The Chamber of Deputies yesterday approved three reforms in support of women. The objective is to make official pre-trial detention appropriate in cases of attempted femicide, penalize the forced cohabitation of minors and for federal, state and municipal authorities to adopt measures to eradicate unions between minors under 18 years of age. with adults.
By 453 votes in favor and 24 abstentions, reforms to the National Code of Criminal Procedure, the National Law of Criminal Enforcement and the Federal Criminal Code were approved in order to impose informal preventive detention in attempted femicides, so that whoever commits the crime may not enjoy conditional, early or preparatory release or the substitution of the sentence.
Prison will be imposed that will not be less than half and may reach up to two thirds of the maximum sentence provided for the consummated crime, which according to the code ranges from 40 to 60 years.
When presenting the opinion, the PAN member Paulina Rubio Fernández pointed out that the document addresses the first signs of femicide, that is, when there is a history of extreme violence and the intention to deprive a woman of life.
On the other hand, the deputies unanimously approved (474 votes) reforms to the Federal Penal Code to sanction whoever forces, coerces, induces or manages a minor to cohabit in a manner comparable to that of a marriage with another person who is in the same condition or is of legal age.
The person responsible will be sentenced to 8 to 15 years in prison and a fine of 1,000 to 2,500 days. The latter will be increased by up to one half, at its minimum and at its maximum, if the victim belongs to an indigenous or Afro-Mexican people or community.
Marriage between minors or early union violates the best interests of children, because it represents an impairment of their fundamental rights to the detriment of their training and development, says the opinion.
