The National Board of Justice (JNJ) resolved to keep the National Prosecutor suspended for six months, Delia Espinozawho had been favored by a court order to return as the highest authority of the Public Ministry.
In the resolution issued today, the JNJ made an interpretation of the ruling of the Ninth Constitutional Court of Lima and concluded that it has only ruled on one of the charges against Espinoza.
In the document, which he accessed Peru21it is noted that the Judiciary annulled Espinoza’s separation solely for not reinstating Patricia Benavides as supreme prosecutor and head of the Prosecutor’s Office, but did not warn that the investigated person is being charged with other charges.
The suspended head of the Public Ministry is also being investigated for not having convened the Board of Supreme Prosecutors (JFS) to incorporate Benavides; for having forced tax personnel to hold a vigil; and for having continued to hold office illegally.
“The precautionary measure of preventive suspension in the exercise of the position established by resolution of September 19, 2025 remains in force, with regard to the other positions, continuing the disciplinary procedure according to their status,” it reads.
Last June, the JNJ annulled the dismissal of Benavides Vargas and ordered his reinstatement as prosecutor of the Nation. However, Delia Espinoza refused to comply, considering that she already held that position by agreement of the JFS.
After Espinoza was separated last September, Tomás Gálvez assumed interim leadership of the Prosecutor’s Office until the JNJ completes the former’s disciplinary process.
