The lawyer and former mayor of La Paz Juan Del Granado explained that the Independent Jurists Association, of which he is a member, proposed the partial change of the Constitution based on a referendum to elect magistrates based on their merits.
He explained that the healthiest thing for a judicial reform is that legislators are not the only ones who are part of the selection process. Notable lawyers, legal entities and universities must participate in the procedure.
“Cancer is located at the head of the Judicial Branch, we are talking about the Supreme Court of Justice, the Plurinational Constitutional Court and the Judicial Council. The magistrates of these courts have been chosen from the lists of the Movement Towards Socialism, which have not selected merits, suitability and background,” he said.
Del Granado indicated that the partial reform proposed by the Independent Jurists group is scheduled to be carried out until the end of this year or until the first quarter of 2023 at most.
The first step, which is the popular consultation, has already been raised. The second is the filling of books to make this process possible; and the last procedure is that the Government or the Supreme Electoral Tribunal (TSE) call a referendum.
“Let us remember that charges are sold in the Judicial Council, sentences are hidden in the Constitutional Court. The case of Judge (Rafael) Alcón is an example of the terrible situation where psychopaths are on the loose, judges are corrupt and society is defenseless. It is not solved with demagogic speeches from the rulers, there must be a deep judicial reform”, pointed out the former mayor of La Paz.
