The defense of former president Álvaro Uribe presented on Thursday the appeal to the sentence in the first instance 12 years in house arrest. With a 904 pages file, criminals Jaime Granados Jaime Lombana ask the Superior Court of Bogotá to lie the sentence issued by Judge Sandra Liliana Heredia.
It should be remembered that Álvaro Uribe was convicted of the crimes of bribery to witnesses and procedural fraud on August 1, after 37 days of judgment in which the Attorney General’s Office affirmed that the former head of state had asked the lawyer Diego Cadena to give bribes to key witnesses imprisoned in 2018, in exchange for not relating it to the creation of the so -called block ‘Metro’ of the Self -Defense.
“The present challenge is intended for the functional superior to review the errors indicated here and restore the affected guarantees and rights, based on the following argumentative axes constituting judicial errors within the aforementioned judicial decision,” says the criminal document.
At the beginning of the document, the defense of former president Uribe reproached the speech of Judge Heredia on July 28, when he issued his sense of the ruling and indicated that the wait was over, and that no one was above justice and law.
The lawyers of the former senator considered that this type of pronouncements “do not correspond to common manifestations in the future of a criminal process and that, given its content and form, they account for the political, subjective, biased and impartial connotation with which the procedural stage was processed.”
Uribe, who is still being held at his farm in Llanogrande (Antioquia), has sustained in recent years the thesis that the trial against him has been a political confine process.
Granados also argued in the document that the judge, apparently, was impartial throughout the process, violating the guarantees of the trial. Already speaking of the probative material, he expressed his rejection of the validity given in the ruling of 1,114 pages to the interception that “by mistake” made the Supreme Court of Justice to Álvaro Uribe in 2018. In a period of 15 days, the high court heard him with an order that he did not go to him, but for the representative Nilton Córdoba under a different case.
Granados has insisted throughout the trial that this evidence lacks validity, since it was obtained illegally, but the Court, the Prosecutor’s Office and Judge Heredia have approved, indicating that, in those days, Uribe committed illegal conduct in their calls with chain.
