The technical defense of former attorney general Jean Alain Rodríguez announced today that it is considering appealing the incidents presented by his client regarding 27 constitutional and due process violations that were rejected in the preliminary investigation, which would lead to the nullity of the trial against his client along with other defendants in the Medusa case.
The lawyer of the former head of the Public ministry, Nelly Rivas said that the Medusa case is riddled with violations of due process and constitutional precepts, such as the right to defense.
The lawyer pointed out that although the regulations establish that the opening of a trial is not appealable, she points out that the incidents can be appealed before the Court.
“We are considering appealing the incidents we have filed for the vices and violations,” said a criminal lawyer from Jean Alain’s defense.
He cited the violations as having filed the charges in the wrong court, the irregular arrest of his client, failure to summon him for questioning, filing the charges out of time, violation of due process and impeding illegal departure.

After about seven hours of waiting, the Third Court of Instruction of the National District delivered digitally the full reading of the sentence of the Medusa case, but many of the lawyers defending the accused did not receive it, because it was allegedly an irregular way, because in their opinion the procedural regulations establish that such delivery must be done physically.

Jean Alain’s defense opposed having it delivered to him digitally and opted for the court to deliver it to him physically, as established by law.
The court must notify the parties to the process who did not receive the digital document, in order to deliver it to them physically.
On June 29, Judge Amauri Martínez, of the Third Court of Instruction of the National District, ordered the referral to trial of the former Attorney General of the Republic, Jean Alain Rodríguez, and others involved in the Medusa case.
The magistrate made the decision by partially accepting a request submitted by prosecutors from the Specialized Prosecutor’s Office for the Prosecution of Administrative Corruption (Pepca), while issuing a writ of dismissal in favor of one defendant and 12 companies as third parties civilly liable.
The judge clarified that the “presumption of innocence is maintained until there is a definitive sentence establishing the contrary.”
The judge ordered that the former attorney general be held accountable in a trial for the facts of which he is accused in the case, as well as the defendants Jhonatan Rodríguez Imbert, Alfredo Alexander Solano Augusto, Javier Alejandro Forteza Ibarra, and Rafael Antonio Mercede Marte.
Likewise, Miguel Jose Moya, Braulio Michael Batista Barias, Alejandro Martin Rosa Llanes, Felix Antonio Rosario Labrada, Ramon Lucrecio Burgo, Johannatan Loanders Medina Reyes, Isis Tapia, Francis Ramirez Moreno, Rolando Rafael Sebelen Torres, Jose Miguel Estrada Jackson, Cesar Nicolas Rizik, Jose Luis Liriano Adames, as well as several corporate names.
The judge also declared the suit filed by the Alfredo Nobel Foundation inadmissible, as it did not have the capacity to act in court in the present case, as it did not have the power of representation.
