Daniel Ortega imposes more control on the National Lottery: This is how he will choose the president of that entity

The general manager of the National Lottery, according to the reforms established in the presidential decree 10-2024disclosed this Friday, August 2 in La Gaceta, will now be chosen by the president of Nicaragua, that is, the dictator Daniel Ortega. Before this reform, those in charge of choosing the person responsible for “managing and administering” this company were the Board of Directors.

The reform of article 12 of the decree 2-95 The creation of the National Lottery establishes that as of August 2, it will read as follows: “the management and administration of the company will be in charge of a general manager, who will be the president of the board of directors, appointed by the president of the republic, who must be a person of recognized honesty, responsibility and competence in matters of administration.”

Furthermore, it establishes among the functions of the person designated as general manager: “to be the legal representative of the company; to submit for approval the organizational and functional structure plan of the company; to submit to the knowledge and resolution of the board of directors all matters of company policies that require approval; to prepare and present annually a general plan of activities and a general budget of operations and investments; and to prepare and present a report on operations, activities and financial conditions of the company.”

He or she will also be responsible for “preparing and presenting the company’s budget and financial statements; submitting internal regulations to the board of directors for approval; and carrying out any functions related to the administration of the company.”

Fewer members on the board of directors

Article 6 of Decree 2-95 was also amended, according to Presidential Decree 10-2024, reducing the number of members of the board of directors, which goes from seven to five members.

“The President of the Republic will appoint the five members of the board of directors and for such positions, they will be required to be a person with a recognized professional career, of notable honorability, outstanding respectability, and moral solvency,” now reads Article 6 of Decree 2-95.

In addition, it indicates that those who will form part of this board of directors are “the Minister of Family, Adolescence and Childhood, co-director of the Nicaraguan Institute of Sports, the general manager of the Lottery, who will also be appointed by the president.”

Article 8 of Decree 2-95, which relates to the functions of the board of directors, also underwent a change in which the power to “appoint and remove the general manager” was removed from the board.

Another of the four reformed articles was number 10, and in this article they also reduced the number of members who must be in a quorum to declare a “simple majority of votes” in the sessions of the board of directors, going from five to three. However, it is important to mention that they maintain that the president of the board of directors will have a “double vote.”
