Cuba will update its legal standards for criminal proceedings

The bills for Penal Enforcement and Penal Code laws are available as of today on Cuban government websites as part of the consultation process for their approval.

The texts were presented the day before Esteban Lazo, president of the National Assembly of People’s Power, by the head of the People’s Supreme Court (TSP), Rubén Remigio Ferro, which complies with the legislative schedule indicated by the Cuban parliament updated in December 2021.

Referring to the Penal Code project, Ferro highlighted its educational and preventive vocation and the need for the country to have updated legislation that provides coverage for new realities that were not sufficiently regulated, such as crimes against the environment, those related with cybersecurity, among others, refers a press release.

The new text expands the rights and guarantees of individuals and incorporates the decriminalization of certain figures, as well as the incorporation of sanctions that do not imply internment.

Ferro explained that the Criminal Enforcement Bill is an unprecedented rule in Cuba, which eliminates the current legal dispersion, applies conciliatory methods for greater harmony in the resolution of conflicts and is consistent with concepts contained in international instruments and treaties of which Cuba is a party.

Lazo reported that the projects complement the process of updating Cuban criminal legislation and, from now on, a consultation process will begin with specialists, deputies and the population, which is distinctive of the Cuban legislative exercise.

During the eighth ordinary period of sessions of the ninth legislature, in December of last year, it was reported that the approval of 27 laws and 14 decree-laws is expected in the next 12 months, in a schedule that responds to the priorities and demands of country development.
