Cuba updates sanctions for violation of regulations for the registration and control of large livestock

The Cuban government updated the sanctions for those who violate what is established in terms of control and registration of large livestock, with the publication of a renewed decree on the subject in the Official Gazette of the Republic.

This is Decree 225 “Of personal violations of the regulations for the control and registration of large cattle and pure breeds”, which dates from 1997, and whose update was recently published in the issue No. 89 Ordinary of the Gazette.

Said norm establishes the violations, fines and other measures to be applied for the violation of the regulations on the control and registry applied in the cattle raisingas indicated a note from the official newspaper Granma.

According to the media, the legislation in force until now was modified taking into account that “the amounts of the pecuniary sanctions that were available in it did not meet the purposes for which they are provided”, which is why, he assures, “it was necessary adjust the values ​​of the fines and update this provision”.

The updated decree indicates that natural and legal persons, owners or possessors of livestock, “are considered responsible for the offenses that are typified, and a fine and other measures are imposed when they incur in any of the 15 violating behaviors defined” in the decree. document.

The publication specifies that among these violations is the failure to properly identify the animals, which is penalized with 10,000 pesos for each unidentified animal, as well as the obligation to identify them in the manner provided and confiscation if there is evidence of that the identification was tampered with.

Meanwhile, if when requested, the owner does not present the document that certifies the registration of the large cattle in the Livestock Registry, they can be fined 500 pesos, the occupation of the animals and the obligation to present the documents within 72 hours later and, if they do not do so, “they proceed to confiscation”.

Granma it also identifies as a violation the failure to declare in the Livestock Registry, within the established term: births of large livestock (10,000 pesos for each animal and the obligation to declare them); deaths of large livestock (10,000 pesos for each unreported death and the obligation to make the declaration); missing large livestock (10,000 pesos for each animal and the obligation to declare them); and sales, transfers or any type of operation that implies transfer of ownership (5,000 pesos for each undeclared animal and the obligation to declare it).

In the same way, it is infringed if the owner does not update the data related to the large cattle before the Livestock Registry, which can be penalized with 20,000 pesos and the obligation to update them.

Other regulations that cannot be breached include the transfer without the established documentation of large livestock from one farm to another located in the jurisdiction of different Livestock Registries; owning a number of cattle greater than the established amount without legally owning land; buy or receive large livestock without the authorization of the competent state agency and sell or transfer this type of livestock without the permission of the same entity, among others.

The decree establishes each one of the sanctions that will be applied to those who fail to comply with the established norms, including the respective monetary amounts of the possible fines.

With regard to the slaughter of cattle, the rule establishes that those who, having the required authorization, fail to comply with the rules established for its execution and the destination of their meat, could also receive sanctions, clarifies Granma.

Those who allow the presence of large or small livestock belonging to them or under their custody in any of the circulation routes, as well as if they introduce or allow the grazing of animals they own on foreign lands or plantations, would also incur in punishable violations.

According to the media, the recent update of the norm states that the natural person to whom any of the foreseen sanctions is imposed can establish the appeal resource before the municipal or provincial delegate of the Ministry of Agricultureauthorities empowered to hear and resolve the appeals filed against administrative acts.

Among the measures adopted by the Cuban government approved in mid-2021 the sale and consumption of beef, milk and derivatives in stores in local currency and in dollars, as well as in other establishments, provided that ranchers deliver to the State a stipulated quota of their production.

Resolution 139/2021 included requirements for the slaughter of cattle, such as proper registration in the registers and the obligation to maintain the growth of the herd.

Coinciding with its application, the island began to experience a growth of theft and slaughter of large livestockwhich did not have a decrease in the first months of 2022, according to Cuban media publications.
