(EFE).- The Cuban government published this Wednesday in the Official Gazette a decree that, among other things, grants rights such as maternity – or paternity – leave to parents and pregnant women by non-profit surrogacy.
According to the text, the State will also extend the benefits for the care of the newborn to people who have opted for the so-called solidarity gestation, one of the points included in the new Cuban Family Code, approved in a referendum on last september.
As highlighted in the decree, one of the principals – the couple who will assume the role of parents after the birth – “if they are a worker, they have the right to enjoy six full days or 12 half days of paid leave, for the purposes of accompany the supportive pregnant woman for her medical care (…) prior to childbirth”.
It also establishes that, after childbirth, the mother or father who “assumes their care, has the right to enjoy a postnatal leave for a period of 12 weeks.”

Once the maternity or paternity leave expires, one of the two will receive monthly financial support equivalent to 60% of their salary, considering the salary they received up to 12 months before the birth of the baby.
In 2022, Cuba approved with 67% the referendum on the Family Code, a package of regulations that includes, among other issues, equal marriage and homoparental adoption. Also contemplates the so-called solidarity gestationwhich includes single people and same-sex couples.
The text emphasizes that it is a right that can only be exercised for “altruistic reasons” and “among people united by family or emotionally close ties.”
Although remuneration is prohibited, the norm admits the “compensation of the expenses that are generated by the pregnancy and the childbirth”. Nor does it specify whether a foreigner who does not reside in Cuba can use this method, although it does clarify that “judicial authorization” is needed to put it into operation.
