Criminal lawyer Francisco Cox and security crisis: “We do not solve the problem with more legislation, but with a well-directed and well-trained police force”

Criminal lawyer and human rights expert, Francis Coxaddressed this Wednesday the security problems that the country is going through in recent times, especially on issues related to organized crime and attacks on Carabineros that has forced the suspension of the district week in Congress to discuss the security agenda.

The death of the police sergeant, Rita Olivares, continues to leave echoes on the public agenda, since it put the resolution of the security crisis that Chile is going through in the urgencies. The Chamber of Deputies is discussing laws to ensure guarantees to the police in the procedures they carry out.

The lawyer in this regard maintained that these laws are ineffective (Nain-Retamal draft Law), since in his opinion they have nothing to do with the phenomenon and the cause.

“A false problem has been created, how many officials of the Carabineros and the PDI are imprisoned or sentenced for having used their firearms in police procedures? Let’s put aside the social outbreak because it is documented,” he said in the program “Al Pan-Pan” by El Mostrador Radio.

The human rights expert added that “it seems to me something for the gallery to leave the public alone, but without the responsibility that this will solve the problem.”

“We do not solve the problem we are experiencing with more legislation, it is solved with a well-directed, well-trained and well-resourced police force, without a doubt, and from what I have heard they have been given. When Carabineros demand for greater resources, you give them,” Cox added.

Congressional discussion

Francisco Cox criticizes the request by parliamentarians to give the police greater powers, since, from his experience, this usually ends badly, as is the case in Mexico.

“What we cannot do is create an uncontrolled super police because what happens with that is what happened in Mexico with Mr. García Luna, who had to be sentenced in Brooklyn because in Mexico he was not sentenced for being coapted by the cartel. of Sinaloa and Beltrán Leiva”, he expressed in this regard.

He also added that the creation of super police officers ends up being linked to corruption scandals. “

When you create police officers without control, corruption phenomena occur and let’s not say that Carabineros de Chile has been absolutely immune to corruption, we clearly have scandals.”

“Punitive Populism”

The expert also maintained that a “punitive populism” is not effective, since it can end in two cases: arbitrary arrests and without evidence; as well as the power of organized crime to organize from prisons.

“Pretending that only imprisonment will solve the problem, the problem is much more complex. Management is what is needed, a well-oriented police is needed,” he specified in this regard.

Cox went further and linked the request for more sentences to what happened to the police officer, Rita Olivares. “You think that the person who shot the carabiniere was thinking about the penalty, it’s that they raise me a grade, I’m going to stop shooting. It’s effective for the morning,” she said.

For the lawyer, the solution lies with the State and the form of investigation of the institutions. “The State can take charge of the criminal phenomenon, but it will not take charge if you lower the investigation standards, for each problem you leave the solution to more pain, it does not solve the problem.”

UN report on the port of San Antonio

The United Nations (UN) delivered a report indicating the port of San Antonio as one of the nerve centers of international drug trafficking. In this regard, Francisco Cox specified that organized crime must be understood as “a kind of company and its behavior is rational.”

To begin to stop this situation, the lawyer insists that the problem lies in the direction of the investigations, since in Chile they focus on the matter (cargo) and not on the structure.

“In Chile, when drugs are seized, weapons are seized, we are not told anything about who the drug is and who the weapons are. This allows us to know what the structure of the gang or group is and who makes it up. Once you put the focus on the structure, you know who makes it up, their modus operandi, their area of ​​influence and probably which authorities are coercing,” he concluded.
