The renewed Criminal Code, promulgated by the Executive Power last Sunday, contemplates cyberbullying, a figure that has been reforming that law more than 140 years ago – it did not exist.

Previously, in article 121, the new Criminal Code indicates that it commits “bullying” who intimidates, insults or incurred mockery or verbal aggressions, encourages exclusion or isolation in the educational, labor, social or any other sphere, with the aim of shame, denigrate, scare, humiliate, manipulate, isolate, generate insecurity and hinder the normal development of a person or group.
The “bullying” will be sanctioned with fifteen days to a year in minor prison and a fine of one to two minimum wages of the public sector. In case of recidivism, it will be sanctioned with one to two years in minor prison and a fine of three to six minimum wages of the public sector.
The Criminal Code will enter into force in August 2026.
