The Court of Justice of Rio de Janeiro this afternoon (22) denied a habeas corpus requested by the defense of the Ecuadorian plastic surgeon Bolívar Guerrero Silva. The professional has been in prison since Monday (18), accused of keeping a patient in private prison, as a way of hiding his state of health after cosmetic procedures on the abdomen and breasts.

The magistrate assessed that there is no illegality in the doctor’s arrest. He also considered the extension of the temporary arrest duly justified, determined yesterday (21) by judge Priscilla Macuco Ferreira, who is in charge of the case. According to her, the Police Station for Assistance to Women (Deam) needs more time to complete the investigation. Priscilla also pointed out that Bolívar tried to disrupt the investigations, making it difficult to access the patient’s chart. THE Brazil Agency could not contact the defense of the plastic surgeon.
According to the indictment, Daiana Chaves Cavalcanti was hospitalized in early June to undergo surgeries at the Santa Branca Hospital, in Duque de Caxias (RJ), the unit where Bolívar works. After the procedures, the 35-year-old patient presented sequelae in the abdomen and had been asking for the transfer because she understood that she was at risk of death, with open wounds. The doctor denied all requests.
Diana appealed to the courts and was finally transferred yesterday (21) to the Federal Hospital of Bonsucesso (HFB), in the north of the state capital. To pay for the transfer and treatment of the patient, it was decided to block BRL 198,000 from the accounts of Hospital Santa Branca and the doctor.
“We wanted her to get out of there. There is no structure there, and the Bonsucesso hospital, we understand that it has references and specialists in the area. Until proven otherwise, we understand that yes. We needed to get it out of there, not only because of what we witnessed, but because there was a medical report from a professional saying that there was no structure there”, he told the Brazil Agency the lawyer Ornélio Mota, who defends the patient.
This is the second time Bolivar has been arrested. The first occurred in 2010, when he was investigated for using unauthorized substances during cosmetic procedures. Since Diana’s case became public, at least 11 other women have gone to the police to file complaints against the Ecuadorian doctor. According to the Regional Council of Medicine of Rio (Cremerj), for irregularities in aesthetic procedures, the plastic surgeon had previously been punished with suspension from the exercise of the profession for 30 days.
