Court sentences man to 30 years in prison for murder and aggravated robbery

SANTO DOMINGO.- The Collegiate Court of Puerto Plata, presided over by Judge Venecia Rojas, handed down 30 years in prison against a man who murdered another and, in addition, for the illegal use of a firearm and aggravated robbery.

Jorvi Apolinar Severino Genao (the Guard and/or Balola) was convicted for the death of Julio Alberto Núñez.

According to the investigation carried out by prosecutor Hilda Patricia Lagombra, the incident occurred on December 27, 2023, around 10:00 p.m., when the victim, who worked as a motoconchista in the vicinity of the Central Park of Puerto Plata, was approached as a passenger by the convicted man.

The accused requested to be transferred to the Los Maestros urbanization and, once there, he demanded the victim stop, threw her to the ground and fired multiple shots at her with a firearm, causing her immediate death due to multiple projectile wounds in the anterior chest, according to judicial highway report No. 703-2023, issued by the National Institute of Forensic Sciences (Inacif).

Subsequently, the convicted man stripped the victim of his TVS motorcycle, model Apache RTR 160, and fled. In his attempt to avoid being identified, he also fired shots at two citizens who witnessed the incident, managing to wound one of them.

The court accepted in all its parts the accusation presented by the Public Ministry, represented by prosecutor Jesús Ernesto Valenzuela, who demonstrated the violation of articles 295, 296, 297, 298 and 302 of the Dominican Penal Code, which classify and punish the crime of murder.

The testimonial, documentary and expert evidence provided during the trial was decisive for the court to dictate the maximum sentence of 30 years of major imprisonment, reaffirming the commitment of the Public Prosecutor’s Office to the effective prosecution of crime and the defense of the victims.

The sentence imposed must be served at the San Felipe Correction and Rehabilitation Center.
