The Civil Chamber of the Superior Court of Bogotá revoked the decision that had forced Congressman Miguel Polo Polo to offer a public apology to the mothers of the victims of the false positives, thus annulling the ruling issued in early December 2024.

Miguel Polo Polo again in controversy. A court to congressman a document that acquits him to apologize to the mothers of Soacha, as well as the relatives of men illegitimately killed by military from the National Army of Colombia, after the incidents generated last November of November 2024.

This ruling ordered the representative to apologize for having thrown boots that symbolized a tribute of Soacha’s mothers to their children, victims of extrajudicial executions.
The Court made this decision after the Pole Pole defense challenged the guardianship ruling.
What does the failure say?
The new resolution determined that the necessary requirements for protection were not met, pointing out the lack of subsidiarity and legitimation of the plaintiffs.
In other words, the court considered that the people who filed the guardianship were not the most affected by the incident, which invalidated the appeal.
The original ruling had considered that the destruction of the memory boots by the congressman, in November 2024, had been an act of hate towards the mothers of the victims of false positives. This act, which was part of the artistic installation
“The boots of memory” in the Plaza de Núñez, had caused outrage in various institutions and sectors, such as the Special Jurisdiction for Peace (JEP), the National Center for Historical Memory (CNMH) and members of Congress, who qualified it as a grievance towards the victims.

Polo Polo, meanwhile, has defended his position several times.
With this new decision, the congressman is fought from the obligation to offer a public apology, which marks a significant turn in this controversial case.
