The Control Court 40 of Caracas, in charge of Judge Yeivy Reinoso Guzmán, decreed a substitute measure of freedom for the two psychiatrists and two nurses who treated the singer Jesús “Chyno” Miranda, while he was admitted to the Tía Rehabilitation Center Panchita.
The member of the duo Chyno and Nacho was admitted to the aforementioned clinic in December 2021 and withdrawn on November 2, 2022.
The precautionary measure granted by the judge involved the release this Sunday of Lionel Sotillo, Vittorio Domínguez (psychiatrists), Danies Moreno and José Chacón (nurses), who had been detained since November 8, 2022 at the Bolivarian National Police, La Yaguara headquarters. , Caracas. They were accused of illegal practice of medicine and nursing, among other crimes.
The information was confirmed by the lawyer Antonio Guerrero, from the psychiatrists’ defense team, who filed a review of the custodial measure. Judge Guzmán analyzed the approach and granted a precautionary measure consisting of presentation every 30 days before the Control Court 40 and prohibition to leave the country.
That decision was agreed on on January 6, but it became effective this Sunday the 15th at noon.
“The criminal process will continue with the defendants released, but if the Prosecutor’s Office did not present a conclusive act, it is because they do not have elements of conviction, and in my opinion, they led the Attorney General into error, since it was demonstrated that they are doctors with the specialty in Psychiatry registered in the respective schools and recognized by the Venezuelan Medical Federation, the Psychiatric Society and the Venezuelan Scientific Society”, Guerrero explained.
After the arrest of the four employees of Tía Panchita, the Public Ministry had 45 days to present the results of the investigation, which could have been a request for a trial, a dismissal or the judicial file. That last path is a time that the Prosecutor’s Office requests to gather the elements that prove the accused crime, according to what the Organic Code of Criminal Procedure says. Apparently, the prosecutor’s file was requested by the Public Ministry on two occasions and was granted by the Court, at whose headquarters there is still no accusation document against the doctors and nurses, said a source.
The arrest of the psychiatrists and nurses occurs after the Ninth Civil Court of Caracas ordered the transfer of Chyno Miranda from Tía Panchita to another clinic where they would treat his drug addiction.
The Public Ministry considered that Tía Panchita did not help him overcome that addiction and therefore imprisoned Sotillo, Domínguez, Chacón and Moreno. After that, Alcira Pérez, the singer’s mother, said she was concerned because at the El Cedral clinic her son was being allowed to “smoke and drink coffee.”
