The 3rd Chamber of Public Law of the Court of Justice of Rio de Janeiro prohibited the state government from using the budget allocated to education to finance public security actions and pay personnel, either through the State Security Integration Program (Proeis) or of similar projects.
The decision, which responded to the request of the Public Ministry of Rio de Janeiro (MPRJ), also determines that the State of Rio return all amounts used during the duration of the program – from 2012 to 2017. The expenses with the program total R$ 147 million, still without monetary correction and interest. The corrected value is yet to be determined. The MPRJ requires that a specific bank account be opened to deposit the amount of the sentence, in the name of the State Department of Education (Seeduc).
The Public Civil Action was filed due to complaints regarding an agreement established between Seduc and the Public Security Secretariat (Seseg), which consisted of a partnership between the Military Police and state schools to provide school security services. The investigations showed that the funds for the cost of personnel and expenses related to the development of the project were used to pay military police officers. “The measure is considered illegal, since the military personnel allocated to the schools performed public security functions and not teaching”, informed the Public Ministry.
