SANTO DOMINGO.– The Second Investigative Court of the National District postponed until March 22 the start of the preliminary hearing against the retired Vice Admiral Félix Alburquerque Comprés, accused by the Public Ministry of causing the death of the communicator Manuel Taveras Duncan, with a weapon illegal fire.
Judge Patricia Padilla adopted the decision for the notification of documents to the parties.
The Public Ministry stressed that it has sufficient evidence that links Alburquerque Comprés to the fact.
At the hearing, the prosecution body was represented by prosecutors María Silvestre, Magalys Sánchez and Laura Vargas.
On August 31, 2022, the defendant received one year in pretrial detention to serve it at the Najayo Hombres Correction and Rehabilitation Center, in the San Cristóbal province.
Alburquerque Comprés killed the communicator Manuel Duncan on August 19, 2022, at approximately 2:30 in the morning.
The incident occurred while they were in a fast food business, located on Avenida Núñez de Cáceres at the corner of Rómulo Betancourt, in the Mirador Norte sector of the National District.
The defendant arrived at the scene laughing, for which Taveras Duncan thought he was making fun of him, circumstances in which the deceased today hit the retired military man.
The now defendant went to his vehicle, from inside which he took out a firearm and began to fire shots at the victim and a companion, who ran out of the establishment.
The file details that Alburquerque Comprés got back into his vehicle to chase them, while Taveras Duncan managed to hide behind a lottery bench, where he was found by his victimizer, who fired two shots at him and left the scene of the crime.
Taveras Duncan died from a gunshot wound to the right hemithorax and exit in the dorsal region, according to the survey report carried out by the National Institute of Forensic Sciences (Inacif).
After committing the act, Alburquerque Comprés got rid of the murder weapon, which he was carrying illegally, since it was not assigned to him by his military institution, says the Public Ministry.
The defendant was placed under arrest by judicial order 0032-August-2022, issued by the Judicial Office of Permanent Attention Services of the National District.
The Public Ministry has qualified the facts in the criminal types described in articles 295 and 304 of the Dominican Penal Code, as well as articles 66 and 67 of Law 631-16, for the Control and Regulation of Weapons, Ammunition and Related Materials, that typify voluntary homicide caused by an illegal firearm.
