Court orders to comply with protection against the arrest of Gilda Lozoya

The third collegiate court in criminal matters in Mexico City ordered compliance with the protection granted to Gilda Susana Lozoya Austin against the arrest warrant issued for her alleged responsibility in the crime of operations with resources of illicit origin and criminal association , in relation to the Agronitrogenados case.

The magistrates asked the control judge with residence in the North Prison, José Artemio Zúñiga Mendoza, to annul once again the arrest warrant against the sister of the former director of Petróleos Mexicanos (Pemex), Emilio Lozoya, and with full jurisdiction dictate a new resolution, which could be in a different sense or in the same way as the previous one, but it should act in accordance with what is established by the first chamber of the Supreme Court of Justice of the Nation (SCJN) in the contradiction of thesis 300/ 2019.

The imparters of justice argued that the togado has not complied with the protection granted to Gilda Susana in March of this year, in which it was determined to found, motivate and resolve whether the Attorney General’s Office (FGR) justified the need for caution to the issuance of the arrest warrant.

Judge Miguel Ángel Medécigo Rodríguez pointed out that although Zúñiga Mendoza fully complied with the disposition to render the arrest warrant null and void; however, he incurred the same vices when issuing the new resolution, since he invoked arguments that were not apparent from the brief requesting the arrest warrant.

According to the investigations of the Prosecutor’s Office, from June to November 2012, more than 3 million dollars were transferred from the company Altos Hornos de México to an account of which Gilda Susana is the beneficiary, money that was allegedly used for the purchase of a residence in the Lomas de Bezares neighborhood.
