The Regional Electoral Court of São Paulo (TRE-SP) suspended this Saturday (5), for 48 hours, the Instagram profile of the candidate for mayor of São Paulo Pablo Marçal (PRTB). The determination is made by judge Rodrigo Capez.
The decision was made in criminal news presented by fellow candidate Guilherme Boulos (PSOL) after Marçal published on his social networks a false report that would point to Boulos’ drug consumption and hospitalization in a clinic due to a psychotic episode.
In the decision, judge Rodrigo Capez states that Pablo Marçal’s Instagram account “has been used to disseminate infamous and untrue facts”.
Furthermore, he points out that there is evidence of at least four crimes provided for in the Electoral Code. According to the judge, “this is news of concretely serious facts, perpetrated on the eve of the electoral election, in theory, with the clear purpose of interfering with the voter’s mood.”
Capez also ordered the opening of an investigation by the Federal Police to determine the facts.
