The mayor of São Gonçalo, Nelson Ruas dos Santos, known as Captain Nelson, from the Liberal Party (PL) is expected to be taken coercively to the Rio de Janeiro Court of Justice to appear at a hearing to be held on the 28th of this month, at 1 pm, in the 3rd Public Law Chamber.
The decision, by judge Nagib Slaibi, is due to the repeated failure to comply with judicial decisions and the apparent occurrence of criminal offenses such as disobedience, in addition to a possible violation of the constitutional precepts of the separation of powers and the possibility of committing a crime of responsibility”.
The mayor was ordered to immediately pay the additional payment for functional performance to municipal guard Carlos Luiz Fernandes, which was already received by other employees, but he failed to comply with the various court orders. The amount currently owed, relating to the payments not implemented, is R$27,758.48.
In the decision, judge Nagib Slaibi also orders the online blocking of the amount in the mayor’s personal accounts.
On May 27, the judge had already summoned the mayor of São Gonçalo, Captain Nelson, by court officer, to “fully comply with the final court order within five days and reinstate the additional payment for functional performance, at its maximum percentage, as previously determined.” Since he did not comply with the final court decision, Judge Nagib Slaib ordered the mayor to appear before the courts to comply with the decision of the 3rd Chamber of Public Law.
In a statement, the city of São Gonçalo reported that it “received with surprise the decision of the Court of Justice in relation to the process, but emphasizes that it will never fail to comply with any final judicial decisions and that it will provide all necessary clarifications”.
