The First Chamber of the Criminal Chamber of the Court of Appeal of the National District annulled the sentence that convicted the alleged false doctor, doctor Karla María Moya Boada in the legal entity Laser Point Rejuvenation Center and ordered a new trial.
The court issued the decision after reexamining the evidence presented against the Venezuelan woman, arguing that the accusation against her had not been proven.
The annulment of the ruling was imposed by judges Doris Josefina Pujos Ortiz (president), Rafael A. Báez García (judge) and Kenya S. Romero (substitute judge), together with the acting secretary Leslie Esmeralda Fernández Calderón.
In the first degree jurisdiction, the First Collegiate Court of the National District had declared the acquittal of Moya Boada, who was accused of practicing aesthetic medicine without authorization from the Ministry of Public Health at the Laser Point Rejuvenation Center by Karla Moya Boada.

Moya Boada, in the previous ruling, was declared not guilty of violating article 156, paragraph 7 of Public Health Law No. 42-01, which establishes economic sanctions against anyone who violates this provision, which include up to 25 minimum wages.
However, the Court of Appeal overturned this decision, ordering a new trial with a full evaluation of the evidence and the transfer of the case to a court other than the one that issued the annulled sentence, in accordance with the provisions of the Criminal Procedure Code.
