Judge Diaulas Costa Ribeiro, from the Federal District Court of Justice (TJDFT), denied habeas corpus filed by the defense of racing driver Pedro Arthur Turra Basso, aged 19. The decision was handed down this Monday (2).
Turra was arrested last week after attacking a 16-year-old teenager. The disagreement occurred over gum thrown at a friend of the victim, who remains in serious condition and admitted to the intensive care unit (ICU) at Hospital Águas Claras, in Brasília.
In the decision, the judge understood that the arrest is necessary to preserve the investigations.
“The aggression carried out by the patient was not a trivial episode, nor was it the result of an excessive impulse typical of youth. The video that informs the original records demonstrates forceful, disproportionate violence and absolutely incompatible with any minimum standard of civilized coexistence”, he stated.
Special prison
Diaulas Ribeiro also said that the pilot does not have the right to special prison and ordered the Federal District Penitentiary Administration Secretariat (Seap) to clarify whether there is a need to keep him in this condition, which was guaranteed by decision of the first instance.
“The patient does not have the right to special imprisonment. And that is not what I assure him. His right, under incarceration, is to have his physical integrity intact”, he added.
Defense
In the request for habeas corpusthe pilot’s defense challenged the arrest order at the first instance and stated that the pilot has a fixed residence, did not attempt to escape and cooperated with the investigations.
According to lawyers, Turra was arrested based on videos published on the internet, without contradiction or judicial validation. Furthermore, the defense said that the accused fears for his safety given the media exposure of the case.
