The Sixth Court of Control of the Criminal Judicial Circuit of the state of Zulia decided on Tuesday, November 29, to release citizen Oswaldo Nava under presentation regime, after having been arrested for attacking the Relic of Our Lady of Rosario de Chiquinquirá with a stone .
Nava, 29 years old and suffering from autism, intellectual disability and schizophrenia, was accused by the Prosecutor’s Office of committing the alleged crime of public incitement.
After five hours of hearing, the man was released under the following conditions: he must be under the care of a relative and he cannot go near the Basilica of Our Lady of Chiquinquirá.
“He is not aggressive. We ask that they treat him as he is, a person with psychological problems, who when he lacks medicine, he upsets him. He has psychological problems, he is not a criminal,” said José Ortega, a neighbor of Nava, who together with family and friends were waiting outside the courts for the presentation hearing to end.

Those who know Oswaldo Nava know that he is innocent. Although they do not agree with the decision, they hope that instead of attacking the Catholic parishioners, they will unite because he lives alone because his parents died.

Brenda Fuenmayor and Diana González, were the relatives who signed to be under the responsibility of Oswaldo Nava. Fuenmayor, who is his maternal aunt, will live with him. For her part, Diana Nava, the man’s cousin, stated that he “was very nervous, cried a lot and says that what he experienced was not easy.”
Oswaldo Nava lived alone in the Raúl Leoni neighborhood, west of Maracaibo, since his adoptive parents died. His neighbors indicated that since his mother’s death in 2021, he does not know which medicines he should take.
According to the account described by the parish priest of the Basilica Santuario de Nuestra Señora de Chiquinquirá, Nedward Andrade, a 29-year-old man entered the sanctuary shortly after 1:00 p.m. sunday november 27 and threw a stone with the intention of damaging the relic.
The Virgin was guarded by servants of María, representatives of the biosecurity group of the Sanctuary Basilica and officials of the National Guard, who arrested the attacker.
