Court imposes a measure of coercion on a Haitian citizen who threw hot water on her teenage daughter
A court in this judicial district imposed a coercive measure consisting of periodic presentation to a woman of Haitian nationalityaccused by the Public Ministry of throwing hot water on a 16-year-old daughter, in an event that occurred in the Pimentel municipality, on September 23.
Judge Josefina Noemí Díaz, of the Judicial Office of Permanent Care Services of the Duarte province, ordered against the woman the periodic presentation every month, for a period of six months, before the Comprehensive Care Unit for Victims of Gender Violence, Domestic Violence and Sexual Crimes, the body of the Public Ministry in charge of the investigation. . The name of the accused was omitted to protect the identity of the victim.
At the hearing the Public Ministry requested the imposition of three months of preventive detention as a measure of coercion, however, the court ordered the periodic presentation, establishing that the defendant is a single mother and has four other children, basing its decision on the fact that it ensures that the rights are not violated. of these.
The event occurred on September 23, around 12:05 in the afternoon, in the aforementioned municipality. The woman, as established in the process, hit the minor with a stick and then put water to boil and threw it on her, causing her burns first and second degree in upper back and neck, according to medical diagnosis.
The case received the provisional legal classification of aggravated domestic violence and physical and psychological abuse, in violation of articles 309-2, 309-3, letter B, of the Dominican Penal Code, and article 396, letters A and C, of the Code. for the Protection and Fundamental Rights of Children and Adolescents (Law 136-03).
