The First Labor Court of First Instance of Santiago condemned Clínica Las Condes for the dismissal of the nurse and former coordinator of the María Luisa Solari Falabella Cancer Center of CLC, Carolina Maraganowho filed a complaint on January 29, 2021.
As revealed Thirdthe judge of the 1st Labor Court of First Instance of Santiago, Andrea Ilagaray, sentenced the venue to pay compensation of $14,594,430. To this is added a surcharge of 30% ($5,108,050) and the refund of the discount made for unemployment insurance of $3,556,905.
The ruling, reported the aforementioned media, establishes that the CLC “incurred in violative acts in the dismissal of the worker, transgressing fundamental rights of article 19 No. 12 of the Constitution, on freedom of expression.
“The dismissal of the plaintiff was adopted as a measure against her as a result of all the efforts and acts through which she expressed the needs and consequences for the unit, its nurses, Tens, and other officials, in addition to the poor attention to highly complex patients, evidently violating their freedom of expression, a constitutionally guaranteed right,” the ruling indicates.
In addition, the court ordered to train their managers “on fundamental rights in the workplace.”
On March 10, the clinic filed an appeal for annulment before the Santiago Court of Appeals.
Let us remember that between 2010 and 2021 a total of 135 legal cases were opened in the 1st and 2nd Labor Court of Letters of Santiago. Since 2020, this number has increased, and in 2021 there were 80, which had not happened in the last decade.
This occurs within the framework of the new administration of CLC, headed by the president of the board, Alejandro Gil, involved in controversies such as the administration of the third dose to his person, in July 2021, when it had not yet begun to be applied.
