Court annuls preventive detention against Vladimir Cerrón in the Antalsis case

The Third National Criminal Court of Appeals annulled the order of 18 months of preventive detention issued last December against the fugitive Vladimir Cerronowner of Perú Libre, for the Antalsis case.

In the resolution dated January 20, the court concluded that the judge of first instance, Jorge Chávez Tamariz, did not properly motivate his decision, at the request of the Prosecutor’s Office, to vary the appearance with restrictions for preventive detention.

The Public Ministry alleged that Cerrón failed to comply with the rules of conduct imposed since he went underground, when he was convicted in the Wanka Aerodrome case, in October 2023. Chávez accepted the same criterion.

However, the court chaired by Judge Ramiro Salinas warned that Judge Chávez Tamariz did not substantiate in his ruling whether there was serious evidence against the former regional governor.

In the Antalsis case, Cerrón Rojas is accused of having joined the criminal organization of Martín Belaunde Lossio and, from the regional government of Junín, between 2011 and 2014, of having directed works in favor of companies related to the political operator who supported the former president Ollanta Humala.

“In this sense, since it has not been adequately examined or justified whether there were well-founded and serious elements of conviction against the accused, according to the standard of strong suspicion, the defect reported by the challenger is evident. This omission is particularly serious, since, as It was widely indicated that revealing suspicion is sufficient to dictate an appearance with restrictions. Therefore, it is the duty of the preparatory investigation judge to verify in each specific case, before analyzing the non-compliance with the rules of conduct, to decide whether to revoke or not. of measurement, analyze the existence of well-founded and serious elements of conviction that prove both the existence of a crime and the connection of the accused,” the resolution reads.

The second instance judges drew the attention of Chávez Tamariz and ordered that another magistrate decide on the tax request.

In this way, the former governor escapes another court order to go to prison. Last December, for example, the Constitutional Court annulled the sentence against the former official of 3 years and 6 months in effective prison for the Wanka Aerodrome case.

Currently, Vladimir Cerrón is under a preventive detention order for allegedly using illicit money, generated by the criminal organization Los Dinmáticos del Centro, to finance the political campaign that brought Pedro Castillo to the Presidency.
