The Permanent Criminal Chamber of the Supreme Court will announce today whether it annuls the trial against the former president Martin Vizcarraaccused by the Prosecutor’s Office of receiving bribes when he was regional governor of Moquegua (2011-2014).
Erwin Siccha, Vizcarra’s lawyer, confirmed to Peru21 that the hearing was convened virtually for 8:30 am.
“What we have always pointed out is that you cannot see in two different procedural stages, in trial and prosecution control, two cases that are the same because the same facts are charged; that is absolute illegality,” the lawyer alleged.
The trial currently facing the former president is for the crime of passive bribery (receiving bribes). However, prosecutor Germán Juárez filed another accusation for collusion that is in the control phase.
“What we request is that the trial be annulled, that we wait for the ruling on collusion, that we check whether they are the same facts because it cannot be possible that we go to trial for the same facts in two different incidents with two different crimes,” Siccha insisted.
On the one hand, the former head of state is accused of having received S/1 million from the Obrainsa company in exchange for granting him the Lomas de Ilo irrigation project; and S/1.3 million from ICGGSA for it to be awarded the construction of the Moquegua Hospital.
Prosecutor Juárez presented effective witnesses and collaborators who confirmed the delivery of the cash in favor of Vizcarra Cornejo.
Despite this criminal process that is about to conclude, and the disqualification issued by Congress against Vizcarra, the former ruler appears on the presidential list of his Peru Primero party with a view to the 2026 elections.
