The Rio de Janeiro Court absolved player Neymar Jr. from paying a fine of R$16 million for construction of an artificial lake at the athlete’s mansion, in Mangaratiba, on the Costa Verde in Rio de Janeiro.
The suspension of the infraction notice was published this Monday (5). The decision was made by Judge Adriana Ramos de Mello, from the Sixth Chamber of Public Law of the Court of Justice. The judge wrote, in the decision, that a report issued by the State Environmental Institute (INEA) “did not find any environmental damage or interventions that required licensing from the institute in the works on the athlete’s artificial lake”.
The report presented in the case file was requested by the Public Prosecutor’s Office of Rio de Janeiro.
The judge’s decision followed the findings of the report issued by Inea, which found no environmental damage or interventions that required licensing from the institute in the construction of the player’s artificial lake.
Judge Adriana Ramos Mello said that “there is clear disproportionality between the conduct attributed to the author and the sanctions imposed”.
“In view of the above, I grant the request for preliminary relief, and the defendant must suspend the enforceability of the infraction reports listed in the initial complaint on behalf of the plaintiff, within a period of up to 72 hours, under penalty of a daily fine of R$10,000 reais”, decided the judge.
Interdiction
After several complaints, the Mangaratiba Department of the Environment banned the construction of an artificial lake at the player’s mansion in the Aero Rural condominium on June 22 of last year due to environmental degradation. During the inspection, according to the department, it was found that there was no environmental or construction license to be presented by the company hired for the construction.
Neymar’s defense filed an appeal on July 24, 2023.
