Since April 14, 2017, with the title of his house in his hands, the husbands Samuel and Indira Graff have traveled civil and criminal courts trying to recover the house they rented in 2014 Emma Luciem Minaya Tavárez, who used as a guarantor the father of the latter, Rodolfo Aurelio Minaya Rancier.
They affirmed that they still do not recover their home despite having a final sentence in their favor, issued by the Supreme Court of Justice (SCJ) of December 28, 2022.

“We have been totally abandoned by justice,” they said, after pointing out that they have been waiting for this high court to issue the definitive ruling of that sentence, which confirms that they are the owners of the house.

They win demands
“That day of 2017 began our ordeal. They began to rain all kinds of unfounded demands, accusing me of violation of private property, association of criminals, all of you in civil and criminal courts,” Indira Graff narrated to El Nacional.

On December 28, 2022, the Supreme Court of Justice (SCJ) rejected the appeal, filed on June 2, 2021, by Emma Luciem Minaya Tavérez against the sentence of the Third Chamber of the Criminal Chamber of the Court of Appeal of the National District on November 12, 2021, which failed in favor of the Graff marriage.
At that time, that judicial instance knew a counterfeit process against the owners through fraudulent documentation.
The same sentence was confirmed by the SCJ, a decision that in turn makes it definitive.
He also ordered that the secretary general of the SCJ notify the parties in conflict.
However, Emma Lucieja Tavárez’s lawyers and his father claim that the SCJ cannot issue a definitive ruling because they have not been properly notified.
On April 30, 2025, a sheriff appeared to the conflict residence to notify the tenants about the sentence, but found the closed house.
They never paid
