The Chamber of Deputies will appeal this Wednesday the ruling of judge judge Diego Martín Cormick on the impossibility of the PRO and the Radical Civic Union (UCR) being able to have a deputy representative each in the Council of the Nation’s Magistracy, according to sources from the Presidency of the parliamentary body.
“The president of the Chamber is going to assert its autonomy to designate its representatives in the Magistracy, complying with the regulations of Deputies and respecting the decision of the blocks, reasons for which tomorrow she will appeal the ruling”Sources close to the head of the body told Télam, Cecilia Moreau.
The advance of the steps to follow was given simultaneously with the request of the block of national deputies of the UCR, which requested that the Chamber appeal the ruling that annulled the designation of the deputy Roxana Reyes, of that party, as representative to the Council of the bench.
The request was made in a note signed by the president of the radical caucus, Mario Negri, and by Reyes herself, a deputy proposed by the UCR block and nominated by resolution of the Presidency of the Chamber to integrate the Council on behalf of the second minority.
“It is an inexcusable and unavoidable duty to file an appeal against the sentence in question, since beyond its ineffectiveness with regard to its annulment component of an administrative act with a fulfilled object, it is appropriate to refute the indication of illegality in what was done by the then president of this Body who issued Resolution 689/22”, the UCR block raised to Moreau.
In addition, the radical deputies asked that the Presidency of the body “also reject the inadmissible injunction contained in point 2 (of Cormick’s ruling) for having been issued without jurisdiction and, most seriously, for trying to impose on this Chamber an action in Ignorance of the clear mandate of Law 24,937 with regard to the power of proposal of the representative legislators in the Council of the Magistracy at the head of the legislative blocks with the greatest representation and the first and second minority, respectively”.
“Since this Chamber of Deputies is the passive subject of the sentence in question, we trust that in her capacity as President of the Body and, especially, in the role attributed to her by article 42 of the Regulations, she will file the corresponding appeal against the in order not to consent to such a serious and illegal judicial determination for the tax that causes not only this block and the deputy Roxana Reyes, but also the Chamber as a whole”.
The Block of National Deputies of the UCR presented a note to the president of the Lower House, Cecilia Moreau, to require her to appeal the ruling signed yesterday by Judge Martín Cormick.

For the radical deputies, “it is also unacceptable that the sentencing judge accuses this Chamber and its members of having concocted a ruse consisting of dividing blocs ex profeso in order to obtain additional representation space in the Judicial Council. Said affirmation is reckless and constitutes an infamy since it is known that the PRO and UCR blocks were always formed as independent and separate entities”.
The judge held in his ruling that the current “assignment of representatives is made with legislators elected in the elections held in 2019 and 2021” and that “in both electoral processes the Frente de Todos (Justicialista Party and others), constituted an alternative to vote ; and the Front Together for Change (PRO, UCR, Civic Coalition), another”.
For the judge, “by granting a member to the block constituted by the PRO and another member to the UCR block, the real second minority of the chamber would be prevented from participating.” Thus, he considered that the Presidency of the Chamber should issue a new resolution, “not being able to grant the representation of the third space to the Radical Civic Union.”
