The Eleventh Chamber of the Santiago Court of Appeals upheld the conviction of former Senator Jaime Orpis Bouchón, and of the others implicated in the Corpesca case, the first case of illegal financing of politics that reached an oral trial.
The instance rejected the annulment appeals filed by the defense of the convicted persons and the Internal Revenue Service (SII) against the sentence of the Third Oral Criminal Court and also finalized the sentences against the former deputy Marta Isasi Barbieri, Raúl Lobos Torres and the Corpesca company.
In the sentence, the court made up of the ministers Jessica González, Graciela Gómez and María Loreto Gutiérrez ruled out errors of law in the sentence that sentenced Orpis to 5 years and one day in prison for six crimes of fraud against the Treasury and 600 days in prison. for two bribery offenses; Isasi Barbieri to 50 days in prison for the crime of bribery; to Lobos Torres to 541 days in prison for a crime of fraud to the Treasury and to the Corpesca company for the payment of a fine of 10,000 Monthly Tax Units for the crimes of bribery and bribery.
The court ruled one by one regarding the grounds for nullity presented by the former senator’s defense and dismissed all of them for well-founded reasons, such as the claim of an alleged infraction due to the adoption of a conviction in a decision adopted by the majority of the judges. who issued the ruling and not by unanimity or eventual error in the argumentation that led to the conviction for the crime of bribery.
Meanwhile, regarding the appeal filed by the Internal Revenue Service (SII), a violation of the norm was also rejected in the acquittal for facilitating false fee tickets.
