Convicted of Operation Ocean will denounce the main victim for extortion

One of those convicted through an abbreviated agreement for Operation Ocean will file a complaint for extortion against the main victim next Wednesday. This is the man nicknamed “the Paraguayan”, due to his frequent trips to that country, according to what they told The Observer sources familiar with the case. She will also denounce another young woman, who at the time of the events was 18 years old and who, in the theory of the defendants’ defense case, was pimping those who were minors.

The convicted person was the “cornerstone” of the case. When the Maldonado Police stopped him with these two young women – whom he now denounces – in his car and the older one pointed him out for having “raped” the younger one, he filed a defamation complaint against them that never prospered. El Paraguayo had also seen Aldana Bonsignore, another of the victims of Operation Ocean who committed suicide and was included in the record of that case.

When the minor appeared drowned in March 2020, her cell phone was checked, the information was triangulated with the Paraguayan complaint and thus the case arose, which later had several chapters.

Initially, he was accused of having had a relationship with Bonsignore and with the main victim. “He admits contempt, understands what the crime of promise and retribution consists of, but maintains that he was misled because he knows them from pages for adults and he goes to the Dazzler hotel where they were asked for their identity cards and that in their story they gave credit for their coming of age. There is an adult who led them into error, ”said his previous lawyer, Santiago Alonso, in May. The contempt that Alonso was referring to is that his ex-sponsored wanted to record one of the court hearings.

He, who was always considered one of the most committed to the investigation, got a shortened agreement to three years and three months in prison. Fifteen months of effective prison – of which 12 have already been computed due to the precautionary measures that he had to comply with – 12 of house arrest and another 12 on supervised release.

In the complaint that he will present on Wednesday at the Maldonado Prosecutor’s Office – to which he agreed The Observer– collects various chats used in the cause where the main victim asks you out. According to the text, it is the minor who contacts him in the first instance and tells him that she has a friend to introduce to him, the other accused, who was already of legal age at that time.

On November 28, 2019, they contacted the convicted person to go to dinner in Punta del Este and the older woman accused him of having raped her younger friend – the main victim. They had a video of the convicted person and the minor having sexual relations. With which, according to the theory of the man’s case, they were going to extort him.

The complaint says that before, they had taken a bottle of white wine. He doesn’t because he doesn’t drink alcohol.

“I told him to take us to my house and to pay us for our silence, if not, we were going to file a complaint,” the young woman of legal age told the Police that night, according to the complaint.

When the Maldonado officer asked her why she recorded the situation instead of helping her friend, she replied: “So that there is evidence, because the situation seems strange to me and that it could happen to other minors.”

In 2020, the young woman of legal age declared that she used drugs and that she worked as a prostitute. In addition, the complaint includes several chats that the Prosecutor’s Office used in its accusation against the other defendants who did not formulate sentence agreements. Among them, some in which the main victim “advises” others how to be with older men in exchange for money. In the eyes of the defendant’s defense, this proves that she was experienced in the “sexual business with a lot of management (…) to the point that she is the instructor of other girls whom she guides and instructs, giving them all the instructions to attract clients and pretending to be of legal age, and how to deceive their customers”. In turn, she recalled that in several cases, such as that of her client, she presented false IDs.

The only one who was imprisoned

This defendant was the only one who was imprisoned for Operation Ocean. He was preventively held for nine months, arguing that there was a risk of flight, at the request of the prosecutor in the Darviña Viera case. She understood that because of his frequent trips to Paraguay, if he left, he could flee there and avoid the process. In June, when he had already signed the abbreviated agreement that did not imply more prison, he was mistakenly imprisoned. The man did not understand what was happening. He was transferred to the Punta de Rieles prison, where he spent eight hours in the Diagnostic and Referral Unit. His lack of understanding made sense: it was an error by the Office for the Supervision of Assisted Parole (OSLA), which was corrected when his lawyer went to court and asked that the problem be fixed. After that, he returned to his house.

How is the case going?

Nine of the 32 defendants accepted an abbreviated agreement in which they accepted their guilt, in exchange for a reduction of up to a third of the sentence. Another 11 will go to trial and the rest were dismissed. The oral trial is delayed by an unconstitutionality appeal filed by the lawyers of the 11 defendants and which is still under consideration by the Supreme Court of Justice.

as he learned The Observer, is under analysis by the last minister and the decision is expected to be known in February. In the document, the defenses replicate chats between the victims that, they understand, prove that there was an “organization made up of young adults and minors, with a previous active and developed sexual life, who offered their services in exchange for money, infiltrating networks social exclusive for adults”.

Thus, they requested the unconstitutionality of four articles. Two from the Criminal Procedure Code itself, one from the law on sexual violence against children and adolescents and one from the law on gender violence.
