Santo Domingo.- One of the two Men who died yesterday in a confrontation with bullets and who was sentenced to 10 years in relation to the attack on the prosecutter David Ortiz, had been released by the judge of the execution of the penalty of San Cristóbalunder the foundation that it met the conditions to obtain probation.
The attempted murder to the Expelotero occurred on June 9, 2019 and the accused were sentenced on December 27, 2022.
Judge José Manuel Arias released José Eduardo Ciprián Lebrón (aka Chuki), sentenced to ten years in prison and who died yesterday morning during a shooting in the liberating sector of Herrera, Santo Domingo Oeste.

Judge José Manuel Arias M, granted probation on November 19, 2024 to the inmate José Chuky, by resolution no. 1527-ORS-2024-00341.
Ciprián Lebrón had been found to violate articles 265, 266, 59,. 60, 2, 295, 296, 297, 298 and 302 of the Dominican Criminal Code; and 66, paragraph V of Law 631-16, on regulation of weapons, ammunition and materials related to Luis Jhoel López Durán, David Américo Ortiz Arias and Sixto David Fernández Vásquez.
Public Ministry
The Public Prosecutor’s Office was represented by the Attorney General Wandy Ramírez Adames, from San Cristóbal, who opposed probation because some documentation that were presented lacked valuation, “I say it because we do not see the certification of conduct and according to the same documentation the inmate participated in the fact from the same center,” the resolution itself collects.
The representative of the persecuting body observed that the guarantor lied by saying that he knew the inmate.
Despite the opposition of the Public Ministry, Ciprián Lebrón promised to live in Catalina, Baní. He served as guarantor Luis Miguel Lugo Ramírez, who promised to give work to the inmate. Also the lawyer Dorian Carlos Phillips Pérez, who represented it.
The decision, contained in Resolution No. 1527-ORS-2024-00341, was issued on November 19, 2024, after hosting the request submitted by lawyers Dorian Carlos Phillips Pérez and Eladio Paula Sánchez, because the inmate complied with the requirements established in the current legislation to access that benefit.
The Court, chaired by Judge José Manuel Arias M., concluded that Ciprián Lebrón meets the legal conditions for probation, in application of the provisions of the Dominican Criminal Code, Law 113-21 that regulates the National Penitentiary System, and Resolution 2087-2006 on humanization of penalty.
During the hearing, the inmate expressed his commitment to reintegrate into society and comply with the judicial provisions that accompany his release.
With this decision, the authorities highlight the principle of humanization of the penitentiary system and the importance of providing second opportunities to those who have shown advances in their rehabilitation process.
Repentance
In the application for provisional freedom, the convicted José Eduardo Ciprián Lebrón (Chuky), presented to the court a letter of repentance handwritten by him, a letter from guarantor Luis Miguel Hugo Ramírez, a psychological evaluation and the certification of courses carried out, as well as the procedural documentation described in the chronology of the process.
