Congress approved Law No. 32242, which modifies Law No. 29944, Teacher Reform Law, which establishes the automatic dismissal of directors, teachers, assistants or administrative staff of public and private educational centers with effective or custodial sentences. suspended and prevented from entering the Public Teaching Career.
This rule details the serious offenses that will be part of the measure. These include the crimes of sexual abuse, terrorism and illicit drug trafficking, as well as physical or psychological abuse of students.
They protect schoolchildren
The director of the Local Educational Management Unit (UGEL) Huancayo, Walter Oré, welcomed the rule. “This modification seeks to protect the physical, psychological and moral integrity of the students. It comes into effect from tomorrow (today, Monday, January 13),” he noted. He clarified that there are no teachers with administrative processes who are still in their assigned jobs, since in the face of the process for a crime, they are separated preventively 24 hours after the fact is known.
Faced with the cases that were recorded in the region, where teachers were separated from classrooms due to various complaints and/or administrative processes, hundreds of students from different levels of education were affected, Oré indicated: “For this year the Ministry of Education created some positions that will help us replace the teacher, not only for two months, but for the duration of the process during the school year.”
Rejection of the norm
For its part, the Unitary Union of Education Workers of Peru (SUTEP) spoke out on the modifications to the Teaching Law, rejecting any act of violence against students and supporting sanctions for those who commit serious offenses. However, he assured that the new law, despite seeking to punish crimes, violates the right to due process.
“This new law, although it seeks to punish criminal acts, violates the right to due process, guaranteed by the Constitution. For SUTEP, it is worrying that laws are promoted that affect workers without considering due process, laws with which Congress only seeks to align more with public opinion than with justice,” expressed the National Secretary of Organization of SUTEP, Héctor Sinche. He added that teacher absences must also be applied fairly, without arbitrariness or abuse of authority.
