Controversial judge Gómez Fierro resigns and will not participate in the election

The controversial judge Juan Pablo Gómez Fierro, who is currently a member of the fourteenth collegiate court in administrative matters, presented his resignation and notified the Senate that he will not participate in any of the popular election processes to occupy the position of circuit magistrate, considering that the constitutional reform to the Judiciary, published in the Official Gazette of the Federation on September 15, is contrary to the values ​​of the Republic and the division of powers.

In a letter he sent to the Federal Judiciary Council (CJF), he indicates that for this reason he requested that the completion date of his assignment be October 31, 2024. I thank the Judicial Branch of the Federation for these 22 years in which I had the enormous privilege of performing all the categories that make up the judicial career; particularly a decade as a federal judge.

When he was second district judge in administrative matters, specialized in economic competition, broadcasting and telecommunications in Mexico City, Gómez Fierro granted the majority of suspensions against regulations such as the Electrical Industry Law and the National Register of Mobile Telephone Users , and the order of the Ministry of Energy (Sener) that forces private companies to buy natural gas only from Petróleos Mexicanos and the Federal Electricity Commission, which earned strong criticism from former president Andrés López Obrador.

Even at the time, when he granted rulings against the Electrical Industry Law, he warned the authorities that if they failed to comply with the suspensions they would be subject to punishment, including prison: A penalty of three to nine years in prison, a fine of 50 to 500 days, dismissal and disqualification from holding another public office, job or commission will be imposed on public servants who do not obey a suspension order.indicates one of its resolutions.

Currently, Gómez Fierro, 40, has held the position of circuit magistrate since February 2024. He served as adjunct professor to Minister Jorge Mario Pardo Rebolledo in the master’s degree in law at the school from which he graduated. In the Supreme Court of Justice of the Nation (SCJN) he was assigned to the presentation of Minister José Fernando Franco González Salas, in 2012.

In the letter sent to the CJF, he assures that during his assignment, I always acted with loyalty, honesty, independence, impartiality, objectivity and professionalism; above all with a great commitment to the institution and to Mexico. I am sure that national history will vindicate the great work of the Judicial Branch of the Federation in the protection of human rights and the defense of the constitutional order.
