Constitutional Court ratifies Uribe’s status as accused in process for witness tampering

The full Chamber of the Constitutional Court ratified the decision made in 2021 and in which he denied former President Álvaro Uribe to remove him from the status of defendant in the process for alleged witness tampering who advances against him.

that court made that decision with a unanimous vote, after studying an appeal presented by the former president’s lawyer, Jaime Granados, against the decision of the Constitutional Court.

It is worth mentioning that the defense of the former president he sought to overturn the November sentence that denied him guardianship and maintained the status of defendant in that process.

The lawyer said that in that decision allegedly there had been irregularities regarding judicial independence by some magistrates of the Plenary Chamber and that the Court had violated the due process rights of his client.

This was derived from statements by Judge Alejandro Linares who referred to the decision insinuating that ‘ex-presidents sometimes communicated with the magistrates’, to talk about the issues under discussion.

“The guarantee of judicial independence is also seriously questioned, to the extent that from inside the Court itself, first anonymously and then from the mouth of the rapporteur himself, he became aware of the existence of factors external to the debate (pressure, calls, veiled threats)”, reads the brief presented by the lawyer at that time.

Álvaro Uribe Vélez is being investigated for the alleged crimes of procedural fraud and bribery, for allegedly having pressured his lawyers to offer economic benefits to paramilitaries so that they would point the finger at the Senator Ivan Cepeda of being behind a setup against the former president and former senator.

The debate on the imputation arose after the decision made by Uribe to resign his seat in Congress, thus losing his constitutional jurisdiction. so that the investigation against him would be undertaken by the Office of the Attorney General of the Nation and not by the Supreme Court of Justice.

The guardianship presented by Uribe was rejected by the Superior Court of Bogotá when it concluded that it was not possible to demonstrate the impact on his fundamental rights with the decision of the Fourth Court of Knowledge issued on November 6, which considered that Uribe was already charged within the process for manipulation and pressure on witnesses.
