The Congressional Subcommittee on Constitutional Accusations (SAC) has a package of constitutional complaints pending resolution for this legislature.
Various sources pointed out The Republic that the new president of this commission would be Congresswoman from the Alliance for Progress (APP) Edith Julian replacing his colleague in the bench Lady Camones.
With APP in the presidency of the Subcommittee on Constitutional AccusationsThe groups that make up the coalition calling itself the Democratic Bloc will seek to ensure that the impeachment and political trial processes advance selectively.
As we have reported, in the Congress intends to disqualify some officials or former officials for alleged constitutional violations or to accuse others of alleged crimes.
Risk of disqualification
Congresswoman Julón, who is tipped to lead the Subcommittee on Accusations, is the delegate of theThe constitutional complaints (DC 362 and DC 464) against former President Francisco Sagasti for alleged constitutional violation.
This is a constitutional accusation for having retired three lieutenant generals and 16 police generals when he was transitional president.
Last month there was a hearing on this case at the SAC, so Julón could already present his final report.
But Sagasti is not the only one they are seeking to disqualify. Former President Martín Vizcarra has three accumulated constitutional complaints (DC 384, DC 400 and DC 466) for the dissolution of Congress in 2019.
Former Prime Minister Salvador Del Solar is also mentioned there.
The delegate in charge of this impeachment is the legislator of Popular Force (FP) Hector Ventura.
Vizcarra also has three constitutional complaints (DC 086, DC 195 and DC 365) for the Vacunagate case. The delegate is the congressman of Honor and Democracy Jorge Montoya.
Another character in the spotlight is the former Minister of Economy Maria Antonieta Alva. She faces DC 103 for alleged incompatible negotiation since one of her father’s companies would have had contracts with the State when she was minister. The delegate in this case is the Congresswoman of the Teachers’ Bloc Elizabeth Medina.
Against the JNE and congressmen
Likewise, the SAC has pending to resolve two constitutional complaints (DC 352 and DC 469) against the president of the National Elections Jury (JNE), Jorge Luis Salas Arenas.
The first case is because the JNE hired political scientist Fernando Tuesta and the second because of alleged incompatible negotiation, which is based on the version of former judge Walter Ríos.
Both processes are in their final stages. The delegate of DC 352 is the congressman of Honor and Democracy Jose Cuetoand the one from DC 469 is the legislator from Fuerza Popular Arturo Alegriawho have been critical of Salas Arenas before assuming responsibility for preparing the final reports of this impeachment.
As those cases progress, Congress aims to once again protect President Dina Boluarte. In the last legislature, DC 425 against Boluarte and his former ministers for theDeaths in the protests was declared inadmissible. It remains to be ratified by the Permanent Commission.
There is another constitutional complaint for the same case, formulated by the Attorney General, Juan Villena, but the SAC has not yet processed it.
The indictment against Boluarte in the Rolexgate case is still pending. The SAC declared it admissible last month.
In the case of congressmen there are also advanced processes.
The DC 375 by the The Children’s Case against parliamentarians Jorge Flores, Raúl Doroteo, Elvis Vergara and Darwin Espinoza is waiting for delegate Jorge Coayla, of Together for Peru, to support the final report.
There are also cases of alleged salary cut.
DC 456 against APP congresswoman Rosío Torres depends on the conclusions of the final report that will be prepared by the delegate, the legislator of the Magisterial Bloc Alex Paredes.
DC 357 against Podemos Peru parliamentarian Heydi Juárez for alleged salary cuts has not yet been resolved. The delegate in this case is FP congressman Arturo Alegría.

Impeachment and impeachment proceedings
Constitutional complaints involve two types of processes: impeachment and political trial.
Impeachment proceedings are based on constitutional complaints about alleged crimes. When approved by Congress, they allow the Public Prosecutor’s Office to formalize the preliminary investigation against high-ranking and former high-ranking officials involved.
The impeachment, on the other hand, is for violation of the Constitution. The sanction in this case is disqualification from public office for up to 10 years.
