The judge of the Seventh Unipersonal Criminal Court Specialized in Corruption Crimes of Officials, Ronald Soto Cortez, sentenced this Tuesday, August 2, the current congressman of the Republic, Wilmar Elera Garciato six years in prison for the crime of aggravated collusion.
The events occurred in 2012 in the district of Pacaipampa (Ayabaca), when Wilmar Elera participated as supervisor of the work ‘Improvement and Expansion of the Potable Water and Sewage System of Pacaipampa – Ayabaca – Piura’.

He also imposed a similar sentence on the former Construction Inspector Wilder Alexander Mogollón and the contractor José Luis Cortegana Sánchez, who together with Elera García must jointly pay a civil compensation of S/ 1,100,000.00 soles.
The full reading of the sentence will be given on August 11 of this year, where the specialized judge will present the arguments that support his decision.
According to the proceedings in the oral trial, this work had a value of S/. 3´ 612,717.68 soles and an execution period of 180 calendar days, whose contract was signed on January 13, 2012, but the work began on May 24 of that year with the partial delivery of the land and the technical file without signature of the designer; however, on January 19, 2012, the Municipality made a direct advance payment of S/ 722,543.54 soles, which corresponded to 20% of the value of the work, and on February 9 of the same year a payment of S/.1,445,087.07 for concept advance of materials, equivalent to 40% of the value of the work.
During the execution phase, when the resident engineer made inquiries about access to the treatment plant, the conduction line to the oxidation pond and others, they were not answered as there was no one responsible for the technical file, which Among other incidents, it led to the work being paralyzed and then financially intervened, and later the municipality was taken to arbitration in which compensation was set in favor of the contractor for more than one million soles.
Also, it is necessary that the physical advance that was made did not adjust to the appraisals presented by the contractor and approved by the supervision.
