The former prosecutor of the Nation Zoraida Avalos filed a constitutional complaint before Congress against the Comptroller General of the Republic, nelson shackshortly before leaving office, on March 30.
According to the document, Shack Yalta would have incurred in the alleged crime of illegal appointment for having appointed Jackelin del Pilar Mellado Alania and Roy Cristian Vera Chung as regional managers of Control of the Comptroller in Moquegua and Ica, respectively, despite not having the required legal requirements.
She mentions that Mellado Alania had no experience in control, having only six months and three days of professional experience, and did not have any of the five professional careers required for the position (she has a degree in Social Communication).

The same goes for Vera Chung, who also has no control experience, as stipulated by law. Both, plus nelson shackprovided their investigative statements.
For Ávalos Rivera, both cases constitute crime of incompatible negotiation or improper use of the positionpunishable by imprisonment for not less than 4 nor more than 6 years and disqualification.
“In this investigation, there is evidence to indicate that the defendant Nelson Eduardo Shack Yalya, Comptroller General of the Republic, was unduly interested in obtaining the appointment of Messrs. Jackelin del Pilar Mellado and Roy Vera Chung as Regional Control Managers, to despite the fact that these did not meet the job description and profile”details the accusation.
Similarly, Shack is also charged with the alleged crime of improper appointment to public officepunishable by 60 to 120 days-fine.
It should be noted that the complaint was forwarded to the Subcommittee on Constitutional Accusations of Congress, in order to proceed with its qualification, as established by the regulations of that State power.
